These Terms of Service ("Terms") govern your use of WHY: The Fifth Mind at whythefifthmind.com (the "Service"), operated by HarmonyAiLabs ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
You must be at least 18 years old to use the Service. By using it, you confirm that you meet this requirement and that everything you provide us (such as your name and email via Google Sign-In) is accurate.
You sign in with Google — we don't issue separate passwords. You're responsible for anything that happens under your account, so keep access to your Google account secure. Each promo code can be used only once, and each account can redeem up to five promo codes in total, one at a time — a new code can only be redeemed after the current trial has ended. Creating multiple accounts to bypass plan limits or trial restrictions is not permitted.
The Service offers a Free tier and paid Pro+ / Power+ subscription tiers, as described on our pricing page. Plan features, limits, and prices may change from time to time; we'll show current pricing on the Service before you subscribe or upgrade.
As of this writing, the Service does not yet process live payments — subscription purchases are simulated for testing. No one is currently being charged. Once real payment processing (via a provider such as Razorpay or Stripe) goes live, this section will govern actual billing, and we'll update this page accordingly.
Once live, paid subscriptions will renew automatically at the end of each billing cycle at the then-current price, unless you cancel before the renewal date.
You can cancel a paid subscription at any time from within the Service. Cancelling stops future renewals; you keep access to your paid tier's features until the end of the billing period you already paid for.
Subscription fees are generally non-refundable once a billing period has started, including for partial use or non-use during that period. We'll honor refunds where required by applicable consumer protection law. If you believe you were charged in error, contact us at the email below and we'll look into it.
Top-up credits purchased beyond your plan's included usage are non-refundable and are valid only until your current billing cycle ends, as shown at the time of purchase. Unused credits do not roll over or carry cash value.

The Service works by sending your questions and attachments to third-party AI providers (OpenAI/ChatGPT, Google/Gemini, Anthropic/Claude, DeepSeek, and others as we add them) to generate responses. Their own terms and policies apply to how they process that content, and we aren't responsible for their acts or omissions. See our Privacy Policy for more detail on this.
We (or our licensors) own the Service itself — its design, code, branding, and the "WHY: The Fifth Mind" name and mark. You keep ownership of the questions, files, and notes you submit. By using the Service, you give us permission to process that content as needed to operate the Service (including sending it to the AI providers described above).
Responses generated by the Service are produced by third-party AI models; we don't guarantee you have exclusive ownership or commercial usage rights over AI-generated output, and different AI providers may have their own terms about output ownership. If you plan to use a debate's output commercially, we'd suggest checking the relevant provider's terms first.
The Service, and everything it produces, is provided "as is" and "as available," without warranties of any kind, express or implied — including accuracy, reliability, fitness for a particular purpose, or uninterrupted/error-free operation.
Debate verdicts and confidence scores are generated by third-party AI models and are for informational purposes only — not professional financial, legal, medical, or other advice. They may be incomplete, outdated, or incorrect despite the peer-review process built into the Service. You're responsible for independently verifying anything you rely on.
To the maximum extent permitted by law, HarmonyAiLabs will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill, arising from your use of (or inability to use) the Service — including decisions made based on its output. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or ₹1,000 (or the local-currency equivalent), whichever is greater.
You agree to indemnify and hold HarmonyAiLabs harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.
We may suspend or terminate your access to the Service at our discretion, including for violating these Terms, misuse, or non-payment on a paid plan. You may stop using the Service and close your account at any time by contacting us.
We may modify, suspend, or discontinue any part of the Service, and may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the jurisdiction of the courts of India.
